BY USING ANY WEBSITE, MOBILE APP, OR SERVICE OF MARKET VIEW PROPERTIES, LLC, YOU AGREE TO ABIDE BY THESE TERMS OF USE (“AGREEMENT”). THIS AGREEMENT INCORPORATES OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU ARE NOT AUTHORIZED TO USE ANY MARKET VIEW PROPERTIES, LLC WEBSITE OR SERVICES.

Our websites and mobile apps (collectively, the “Websites”) provide information about our real estate services, including cash offers for properties (“Services”).

3. User Conduct & Restrictions

  • You may use the Website only for lawful purposes related to evaluating or using our Services.

    • attempt to interfere with the operation of the Website, including transmitting viruses or spam,

To the fullest extent permitted by law, Market View Properties, LLC, its affiliates, and Vendors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website or Services.

If liability is ever found, it will be limited to the greater of:

  • $100, or

  • 10% of the total amount you paid to Market View Properties, LLC for Services giving rise to the claim.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

You agree to defend, indemnify, and hold harmless Market View Properties, LLC and its affiliates, employees, and contractors from all claims, liabilities, damages, costs, and expenses (including attorneys’ fees) arising out of your use of the Website, Services, or violation of these Terms.

10. Unsolicited Marketing

We do not permit the use of our Services to send spam or unsolicited communications. Users who misuse our Services for spam may have access suspended or terminated.

11. Governing Law and Venue

These Terms are governed by the laws of the State of California. Any disputes shall be resolved exclusively in the state or federal courts located in San Diego County, California.

12. Miscellaneous

  • Termination. We may suspend or terminate your access at any time.

  • Assignment. You may not transfer your rights under this Agreement without our prior written consent.

  • Severability. If any provision is unenforceable, the remaining provisions will continue in effect.

  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Market View Properties, LLC.
